Thank you for choosing Evify as your supplier of EV chargers and other accessories for your car and an extra big thank you for taking the time to carefully read our terms and conditions of purchase.

We would like to start by briefly explaining why we have created these purchase conditions. Our basic goal is to ensure in a clear and easy-to-read manner that you understand the conditions that apply to the purchase, delivery and installation of our charging boxes.

Our aim is that, after reading these terms and conditions, you should feel confident in your choice of Evify and the products we deliver. If you have any questions or concerns, you are of course most welcome to contact us. Thank you for your trust and thank you for choosing Evify!

1. Parties

These general terms and conditions of purchase apply to all individual agreements for the purchase of goods or services entered into between a customer, which means a natural or legal person (hereinafter referred to as "the Customer") and Evify Sweden AB, registration number 559176-2496, Hangövägen 19, 115 41 Stockholm (hereinafter referred to as "Evify"). In the following, the customer and Evify are jointly referred to as the "Parties".

2. General information and scope

2.1 These purchase conditions apply to Evify's sale of charging box, charging post, charging station, charging cable or other equipment (referred to as "Charging Equipment") to the Customer, as well as for installation services in connection with the purchase of Charging Equipment ("Installation").

2.2 Evify's terms of purchase may be updated from time to time after the Parties have entered into an agreement. It is always the most recently drawn up terms and conditions of purchase that are valid and it is the Customer's obligation to read the latest version of the terms and conditions of purchase. The version of the purchase terms valid at any time will be available on Evify's website, www.evify.eu.

2.3 All prices for Charging equipment, Installation can be seen from Evify's current price list at any time, available via www.evify.eu. Evify reserves the right for possible printing errors, incorrect price information and sold-out goods.

2.4 Evify intends for all information about our product and service range to be accurate and as up-to-date as possible. However, Evify cannot guarantee the correctness of the information presented on the website or our product and service range in general. Evify cannot be held responsible if the website is down or if any functionality does not work as expected.

3. Products

3.1 Evify provides a wide range of car accessories, including charging boxes, charging posts, charging stations and charging cables. A complete and updated list of all products offered is available at www.evify.eu.

3.2 All products sold may only be used in accordance with the respective product's instructions for use. Charging equipment may only be used to charge the type of electric car and with the amperage for which the charging equipment is designed.

3.3 In the event that the Charging Equipment is used to charge cars of a different type or with a different amperage than that for which the Charging Equipment is designed, the Customer is solely responsible for any damage to the Charging Equipment and the car.

4. Orders

5.1 The customer simply places their order via Evify's website. When Evify receives the Customer's order, the order is confirmed by sending an order confirmation to the Customer at the e-mail address that has been provided.

5.2 The customer must carefully read the received order confirmation and check that the order confirmation corresponds to the order. Any deviations between order confirmation and order must be notified to Evify immediately.

5.3 In connection with the order, the Customer authorizes Evify to retrieve information about the Customer's installation details, electricity network subscription, historical and current data available from the Customer's electricity meter via the network owner, as well as to find out who the customer's electricity supplier and balance responsible are. The customer gives Evify the exclusive right to analyze the current data and control the charging itself or the person Evify hires in its place.

5. Payment

5.1 When you book products or installation via our website, you can choose to pay by bank transfer or card. When paying by bank or credit card, Adyen manages all bank transactions connected to our services, by checking that your card is valid for purchases directly against your bank. Your card details are transmitted directly to your bank via Adyen's system, and we at Evify do not handle any bank or credit card numbers ourselves.

5.2 Your payment is handled by Adyen with secure encryption and according to strict banking standards, so-called PCI DSS (Payment Card Industry Data Security Standard). It also happens that some purchases of our services are covered by 3D Secure (Verified by Visa and MasterCard SecureCode), in the event that this security mechanism is activated on your debit or credit card.

5.3 Evify do not charge any extra fees for card payments. However, it may happen that your bank charges an extra fee depending on the card type and bank. In the event that no payment is received after you have sent your order, the order may be automatically cancelled.

5.4 In the event of non-payment, late payment interest is charged according to the current law on interest for late payment. Fees may also be charged according to Danish laws.

5.5 Prices are stated in Euro (EUR) and include VAT. If you visit evify.eu as a company, it is possible to show the prices excluding VAT. Shipping cost and any administrative fee may be added. Evify reserves the right for any errors, such as price information, promotions, discount codes or product information that may occur.

6. Delivery and terms of return

6.1 Evify leaves a 30-day open purchase on non-installed products for 30 days from the time of purchase. For a return to be accepted, the products must be well packaged, in undamaged condition and returned in the unbroken original box.

In the event of an unapproved return, a deduction of 15% will also be made. This deduction occurs if the goods have not been returned well packaged, in undamaged condition or in the original box and if the goods are returned after more than 30 days from the time of purchase. If the item is damaged or has been assembled, the return will be refused and no refund can be offered.

6.2 Delivery of Charging equipment and any associated Installation takes place according to agreement between the Parties and estimated dates for all or parts of delivery must be stated in the order confirmation.

6.3 Estimated delivery time for all or part of the delivery may change. If nothing has been specifically agreed in writing, no compensation is paid for delayed delivery.

6.4 Returns made after 30 days of receiving the products will be subject to a 15% return deduction.

6.5 The packages are delivered to an agent and lie there waiting to be picked up for 14 days. If the item is returned after the specified deadline, the customer is charged a fee of 30 EUR for costs related to Evify's administration, shipping, return shipping and handling. Unredeemed packages are not covered by the right of withdrawal.

6.6 If, by chance, you should receive an item that you did not order, please contact our support at info@evify.eu and we will help return the item.

6.7 Should you discover damage to your package, report it immediately to the delivery point where you picked up the item. There you will also get help to file a claim. We recommend that you do not pick up a package that is damaged, as the damage can then no longer be attributed to the transport. If you discover the damage only when you have opened the package and the damage is such that it can be linked to the transport, contact the agent to file a damage report no later than five days from when you received your item.

6.8 Returns are at your own expense, with the exception of the case that the item is defective or incorrectly delivered. Returns must be sent as Private Package. Returns by letter or cash on delivery are not accepted. In case of exchange, it is carried out free of charge within 30 days of receiving the products, and we can also decide to carry out the exchange free of charge after 30 days.

6.9 Evify sends your goods as a package within Denmark. Currently, we cannot offer deliveries to other countries.

7. Warranty

7.1 Warranties on goods are provided by the products' respective manufacturers. Evify provides no additional guarantees beyond the respective manufacturer's specified guarantee conditions.

8. Claims

8.1 According to the Consumer Purchase Act, the complaint period for a product is three years. In order to invoke the right of complaint, it is you as the customer who must prove that the fault in the product was present at the time of purchase. This must be done within a reasonable time after you noticed or should have noticed the error.

9. Responsibilities

9.1 Evify is not responsible for errors, interruptions, disruptions, power quality and the like that may arise from other service providers, including electricity suppliers, electricity producers, electricity network providers and internet providers.

9.2 Evify is also not responsible for damages or losses incurred by the Customer due to incorrect use, including, but not limited to, incorrect loading, computer viruses and the like.

9.3 Evify is not responsible for any errors, damages or losses incurred by the Customer due to Installation. All matters relating to Installation must be handled directly between the Customer and the installer.

9.4 The buyer is responsible for ensuring that the electric vehicle intended for charging is compatible with the Charging Equipment. Evify is not responsible for damages that occur because the electric car and the Charging Equipment are not fully compatible.

10. Processing of personal data

10.1 In accordance with the Data Protection Regulation (GDPR) and in order to facilitate case management, the Customer is informed that the personal data submitted to Evify will be used in Evify's word and text processing, record keeping, accounting, other administration and e-mail.

10.2 When purchasing Charging equipment, Installation or cloud service, the Customer must provide information about name, social security number, civil registry address, telephone number and e-mail address. In connection with the purchase of Installation services, the installation address must also be stated.

10.3 Evify is responsible for your personal data being processed in accordance with current legislation.

10.4 Evify will, at your request or on its own initiative, correct, de-identify, delete or supplement information that is found to be incorrect, incomplete or misleading.

10.5 The customer has the right to request access to their personal data. This means that the Customer has the right to request a register extract of the processing we carry out regarding his personal data. The customer also has the right to receive a copy of the personal data that is processed. Once per calendar year, through a written and signed application, the Customer has the right to obtain, free of charge, a register extract from which personal data is registered about the Customer, the purposes of the processing and to which recipients the data has been or is to be disclosed. The customer also has the right to receive information in the register extract about the anticipated period during which the data will be stored or the criteria used to determine this period.

10.6 The customer has the right to correction of his personal data. Evify will, at the Customer's request, correct as quickly as possible the incorrect or incomplete information Evify processes about the Customer.

10.7 The customer has the right to deletion of his personal data. This means that the Customer has the right to request that his personal data be deleted if it is no longer necessary for the purpose for which it was collected. However, there may be legal requirements that Evify may not immediately delete the Customer's personal data, as a result of, for example, current accounting and tax legislation.

10.8 The customer has the right to object to personal data processing that is carried out on the basis of a balancing of interests. If the Customer objects to such processing, Evify will only continue the processing if there are legitimate reasons for the processing that outweigh the Customer's interests.

11. Right of return

11.1 A consumer has the right to cancel their purchase of Charging Equipment by sending a message to info@evify.eu within thirty (30) days from the Customer's receipt of Charging Equipment. A standard form for exercising the right of withdrawal can be requested from Evify via the above email address.

11.2 When using the right of withdrawal, a return fee of 20 EUR can be charged to cover shipping costs. Returns should be well packed, in good condition and returned in the original box which is unbroken, without undue delay and in any event no later than 30 days after you communicated your decision to exercise the right of withdrawal.

11.3 In the event of a refund, we will use the same payment method that you used for your order.

11.4 Evify has the right to delay the refund until we have received and checked the returned products.

11.5 If you have managed to use your item and use the right of withdrawal, it may mean a certain reduction in value, at your expense. These cases are handled individually.

11.6 A consumer has the right to cancel their purchase of installation by sending a message to info@evify.eu within thirty (30) days of ordering. A standard form for exercising the right of withdrawal can be requested from Evify via the above email address. If the Customer wishes to have Installation carried out within thirty (30) days of ordering, the Customer must consent to the commencement of Installation, where he also acknowledges that there is no right of withdrawal for completed service. In the event that the Customer wishes to start Installation within the said period and in the event that the Customer exercises its right of withdrawal during, the Customer must compensate Evify for a proportional share of the agreed price for Installation that was partially performed before the Customer exercised the right of withdrawal.

12. Miscellaneous

12.1 Evify has the right to assign its rights and obligations under these Terms. The Customer is not permitted to transfer his rights and obligations. Furthermore, Evify has the right to engage subcontractors for the fulfillment of its obligations.

12.2 Disputes arising from these conditions must be settled in a Swedish court and according to Swedish law.
